Minister of Manpower: THR for Workers Must Be Given Maximum D-7 of Eid

Jakarta - The provision of Holiday Allowance (THR) for workers/laborers is a tradition and as one of the efforts to meet the needs of workers/laborers and their families in celebrating Religious Holidays. This policy is intended to improve the welfare and protection aspects for workers.

In accordance with the Regulation of the Minister of Manpower (Permenaker) Number 6 of 2016 concerning Religious THR for Workers/Laborers in Companies, Religious THR is non-wage income that must be paid by employers to workers/laborers before Religious Holidays.

"THR payments for workers/laborers must be given once a year by the company and the payment must be in accordance with each religious day and must be paid no later than 7 days before the Religious Holiday," said Minister of Manpower M. Hanif Dhakiri at the Media Gathering event at the Ministry of Manpower office, Jakarta on Tuesday (6/6).

Based on Permenaker No.6/2016, workers/laborers who have worked for 1 month are entitled to receive Religious THR from the company. Workers/laborers who have worked for 12 months continuously or more will receive THR of one month's salary.

Meanwhile, workers/laborers who have a minimum of 1 month of continuous work but less than 12 months, are given THR proportionally, by calculating the number of work periods divided by 12 (twelve) months multiplied by one month's wages. However, for companies that have regulated the payment of religious THR in work agreements, company regulations (PP), or joint work agreements (PKB) and it turns out to be better and greater than the provisions above, then the THR paid to workers/laborers must be based on the PP or PKB.

To oversee the payment of THR from Employers to Workers/Laborers, the Ministry of Manpower opened the 2017 Eid Care Post located at the Ministry of Manpower's One-Stop Integrated Service Center (PTSA), Building B, Ministry of Manpower Office, Jl. Gatot Subroto Kav. 51, South Jakarta.

"Not only is it a means for workers to report THR issues, the Post can also be a reference for companies to seek information and consult regarding THR payments based on Permenaker No. 6 of 2016," said Haiyani Rumondang, Director General of Industrial Relations and Social Security for Workers (PHI and Jamsos) of the Ministry of Manpower.

"We have also asked the provincial and district/city governments to form a Care for Eid Employment Task Force Post to support the successful implementation of this year's Religious THR payments," said Haiyani.

Strict Sanctions for Negligence in Paying THR

Meanwhile, the Director General of Manpower Supervision and Occupational Safety and Health (PP and K3) Maruli A. Hasoloan said the government continues to carry out strict supervision of the implementation of THR payments in 2017.

This is in accordance with the Minister of Manpower Regulation No. 20/2016 concerning the procedures for imposing administrative sanctions, Government Regulation (PP) Number 78/2015 concerning Wages which regulates strict sanctions for companies that fail to pay THR.

"Employers who are late in paying THR will be subject to a fine of 5 percent of the total THR that must be paid to their workers/laborers to improve worker welfare," said Maruli.

In addition, Maruli said, negligent entrepreneurs will also be subject to administrative sanctions. Sanctions will be given to entrepreneurs who are proven to have violated including sanctions in the form of written warnings and sanctions for limiting business activities.

Maruli further said that the imposition of sanctions in the form of restrictions on business activities takes into account several things. Namely, the reasons why the written warning was not implemented by the entrepreneur and considering the company's financial condition as seen from the financial statements for the last 2 years, and audited by a public accountant. "Sanctions in the form of restrictions on business activities are imposed until the entrepreneur fulfills the obligation to pay religious THR," said Maruli.
