DisnakerPMPTSP Malang City Clarifies Legality of Three Business Places

Klojen (malangkota.go.id) – The Malang City Manpower, Investment, and One-Stop Integrated Service Agency (DisnakerPMPTSP) held a meeting with three noodle restaurants, namely Mie Kober, Mie Gacoan, and Wizzmie at the Public Service Mall (MPP), Wednesday (7/6/2023).

The meeting held to confirm licensing and other matters for the three businesses also involved various related parties, including five other technical regional apparatuses (PD), namely Satpol PP, Dishub, Bapenda, DLH, and DPUPRPKP Malang City.

Head of the Malang City Manpower and Transmigration Office, Arif Tri Sastyawan, said that this meeting aims to find a joint solution in resolving the licensing of noodle restaurants related to seating capacity, branch locations, and licensing requirements that must be completed.

For Mie Kober, he said that the seating capacity data listed in the Environmental Management Statement Letter (SPPL) differed from the actual situation in the field. "The restaurant reported 86 seats in the SPPL, but there were 150 seats in the place. This inconsistency is negligence in submitting permits, not an attempt to avoid taxes," explained Arief.

In the regulation from the Ministry of Transportation, Arif explained that the 100-300 classification is a technical recommendation. "There are already regulations for that. So these entrepreneurs are indicated as dishonest. The tendency is not to avoid taxes, but to be reluctant to take care of them. Let them not have any dealings with the Transportation Agency. But with the increasing number of seats, automatically there is a risk of additional parking," explained Arif.

Meanwhile, for Mie Gacoan, it is related to the location of the new branch. He emphasized that a direct review is needed to ensure whether the location of the branch is in the Lesanpuro or Sawojajar Sub-district area. "We will coordinate with various related parties to verify the truth of the location submitted in the permit application," explained Arief.

"That's why today our friends went down to the field to meet the RT/RW Heads, the Lesanpuro and Sawojajar Village Heads, and the Sub-district Heads. This is to ensure which area it falls into. We're afraid that once the Suitability of Space Utilization Activities (KKPR) is out, we'll issue Lesanpuro, but it turns out the location is in Sawojajar," he explained.

The same thing was also experienced by Wizzmie Restaurant, Arif said that the place was faced with licensing requirements. Documents that need to be completed are related to the Environmental Management Statement Letter (SPPL) and Traffic Impact Analysis (Andalalin).

On this occasion, Arief emphasized that the Malang City Manpower and Transmigration Office (DisnakerPMPTSP) will actively monitor the progress of completing the permits for the three noodle restaurants.

He emphasized that the main goal is to find the best solution to resolve this problem without disrupting the continuity of restaurant operations, taking into account the impact on the workers involved.

"There is no time limit. The agreement was to be monitored every week. This week it will be monitored by friends including from Satpol PP. So waiting for any developments in the processing of the missing permits. Every week it will be monitored by Satpol PP, that's today's agreement," he explained.

Separately, Mie Gacoan Legal Team, Nabil Muhammad Fatoni, revealed that until now his party is still in the process of completing the permits. Including confirming with the National Land Agency (BPN) regarding the certainty of the location of the new branch.

However, Mie Gacoan, according to him, will continue the construction. Given that several permits have been completed. "The construction is still until finishing, several permits have been obtained. Our Building Construction Approval (PBG) is in process, but for the temporary direction, the construction is still ongoing, because the permits are also in process," explained Nabil.

The same thing was also conveyed by the Mie Kober legal team, Suparno, he clarified the matter of seating capacity which according to him, the capacity at Mie Kober was in accordance with what was submitted in the SPPL document.

"Actually it is in accordance with the SPPL. Only yesterday when there were guests, we added it suddenly. Incidentally we also invited the Transportation Agency and the photo changed. But it doesn't matter, we will also recommend it to Andalalin," Suparno argued. (say/yon)
